Court of First Instance of Thessaloniki at the relevant request of the lawyers of ARSIS &#8211; Association for the Social Support of Youth<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The seventeen-year-old Y. from Pakistan was identified and supported by the ARSIS Street Work team, a member of the National Emergency Response Mechanism for unaccompanied minors in precarious living conditions in Thessaloniki. He had made an application for international protection, which was rejected. The case was referred to the ARSIS Advocacy team, which represented the minor in court and succeeded in suspending his return to his country of origin, as well as the re-issuance of the asylum seeker card. More specifically, upon our request, the Single-Member Administrative Court of Thessaloniki issued judgment No 43\/2024, according to which &#8220;&#8230; the Court, taking into account in particular the young age of the applicant, who entered Greece as an unaccompanied minor and therefore belongs to a vulnerable population group, and that the alleged claims [&#8230;] consisting of avoiding the risk of life and physical integrity, it considers it appropriate to order that the enforcement of the return measure imposed on the applicant be suspended [&#8230;]\u201d The same decision ordered the administration to re-issue the applicant\u2019s asylum card to the child and to refrain from any action that would result in the forced return of the minor.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In the last two years at least 54 children have been granted temporary protection under the same procedure, following our requests. Submitting an application for annulment to the Administrative Court of First Instance is the only appropriate legal option for asylum seekers when their application for international protection is rejected at second instance.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Unaccompanied children, for whom the Greek state and the European Union ensure that they are provided with housing, food, clothing, access to education and healthcare, a guardian responsible for handling their affairs, cannot yet acquire legal residence in Greece. The above legislative gap is temporarily filled by the submission of an application for international protection. However, it is a fact that only a percentage of these children have reasonable grounds for obtaining international protection status.
