Two Afghan nationals, parents of five minors and already recognized beneficiaries of international protection in Greece, were successfully represented in a criminal case by the Lawyer of the Advocacy Group of our organization, ARSIS – Social Organization for Youth Support, Ms Argyriou Anthi.<\/p>\n\n\n\n

The specific criminal case, which was heard in the second degree at the Three-member Criminal Court of Thessaloniki for misdemeanours, concerned the offences of possession and use of forged documents, illegal entry into Greece and attempted unlawful exit from the country.<\/p>\n\n\n\n

In the context of the defence and given the first-trial conviction of our beneficiaries, the Legal Service of #ARSIS put forward the appropriate legal and substantive arguments, emphasizing the fact that according to the provisions of the supra-legislative force of the Geneva Convention on recognized beneficiaries of international protection, as per the national legal framework Laws 3386\/2005 and 4251\/2014, there is a personal reason for exemption from the penalty for the offences of entering and attempting to leave the country illegally.<\/p>\n\n\n\n

Further, the defence proved that the defendants did not know and could not have known of the forgery of the travel documents, nor did they have any benefit from such an action, as recognized beneficiaries of international protection.<\/p>\n\n\n\n

Our beneficiaries, with the prosecution’s consent, were found not guilty of all the charges against them and the first court decision disappeared, preventing further adverse consequences to the detriment of both themselves and their minor children.<\/p>","protected":false},"excerpt":{"rendered":"
