{"id":20602,"date":"2019-10-10T19:27:18","date_gmt":"2019-10-10T16:27:18","guid":{"rendered":"http:\/\/www.arsis.gr\/?p=20602"},"modified":"2019-10-10T19:27:18","modified_gmt":"2019-10-10T16:27:18","slug":"press-release-the-echr-grants-interim-measures-putting-an-end-to-the-detention-of-unaccompanied-minors-in-police-stations","status":"publish","type":"post","link":"https:\/\/arsis.gr\/en\/press-release-the-echr-grants-interim-measures-putting-an-end-to-the-detention-of-unaccompanied-minors-in-police-stations\/","title":{"rendered":"Press Release: The ECHR grants interim measures putting an end to the detention of unaccompanied minors in police stations"},"content":{"rendered":"<p style=\"text-align:right\">Thursday, 10 October 2019 <\/p>\n\n\n\n<p>Today, \u03bfn 10\nOctober 2019, the European Court of Human Rights, issued a\ndecision on interim measure, under rule 39 of the European\nConvention on Human Rights (ECHR) in which indicates to the Greek Government:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>to transfer the unaccompanied minors who applied to the Court and are detained at police stations, to suitable accommodation centres for unaccompanied minors <\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li>to ensure that their reception conditions are compatible with Article 3 of the Convention and the children\u2019s particular status<\/li><\/ul>\n\n\n\n<!--more-->\n\n\n\n<p>Moreover, the ECtHR set the Greek Government a\ndeadline by 11:00 hours tomorrow to provide responses:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>concerning the detention conditions of the unaccompanied minors who were transferred from the police stations to the Amygdaleza Pre-Removal Detention Centre and the impact of that detention on their physical and psychological integrity <\/strong><\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>concerning the actions\/measures taken by the Greek authorities for the transfer of the above-mentioned minors to an adequate shelter for minors as well as the time that the transfer is expected to take place.<\/strong><\/li><\/ul>\n\n\n\n<p>Moreover, <strong>the ECtHR requests a response on \u00a0what concrete measures have been taken concerning the appointment of a guardian for each of the minors\/applicants \u00a0to the Court, <\/strong> while asking \u00a0to ensure reception conditions for those minors according \u00a0to Article 3 ECHR, including one child who was transferred \u00a0to a \u201cSafe zone\u2019 in the Reception Centre at Ritsona, Attica.<\/p>\n\n\n\n<p><strong>On 20 September 2019, the Intervention Team in Detention of ARSIS &#8211; Association for the Social Support of Youth, have found<\/strong> <strong>all those unaccompanied minors being detained at the Kolonos Police Station under conditions which constitute inhuman and degrading treatment<\/strong>. No guardian had been appointed for any of them. Until then none had been informed about the reason and the duration of their detention. ARSIS\u2019 lawyers informed the children for the reason of their detention, in particular 14, among them were detained under \u201cprotective custody\u2019 and 6 under deportation procedure. <\/p>\n\n\n\n<p>&nbsp;ARSIS implements\nan intervention programme in Amygdaleza Pre-Removal Detention Centre and police\nstations, offering legal assistance and psychosocial support*. The team of ARSIS\nhad immediately informed all the competent state authorities for the detention\nconditions of minors, and the need to put an end to their detention and to\nimmediately transfer them to suitable accommodation shelters. However, by 4\nOctober they had received no response.<strong> The minors continued to be detained and\ninstead of being transferred to suitable accommodation facilities, 9 of the minors\ndetained at the Kolonos Police Station were transferred, for the continuation\nof their detention, to Amygdaleza Pre-Removal Detention Centre <\/strong><strong><\/strong><\/p>\n\n\n\n<p>On 5 October 2019 Members of the legal team at ARSIS\u2019\nYouth Support Centre have submitted an application and requested the intervention of the European Court of Human Rights,\naccording to the procedure of interim measures, in order to put an immediate\nend to the violations of fundamental rights of the minors and to oblige the\nGreek state to take the necessary measures to protect them. The ECtHR accepted\nthe application of interim measures with its Decision. <\/p>\n\n\n\n<p><strong>The present decision<\/strong> of <strong>the Court is of high importance since it highlight\nthe unlawful detention of unaccompanied minors, now in police stations, under\ninhuman and degrading conditions, as a form of protective custody, in the\nabsence of child protection structures.<\/strong><\/p>\n\n\n\n<p><a href=\"http:\/\/www.arsis.gr\/en\/arsis-detention-of-a-large-number-of-unaccompanied-minors-in-the-amygdaleza-pre-removal-detention-centre-under-unacceptable-conditions-and-for-long-periods\/\"><strong>ARSIS\nis deeply concerned about the practice of detaining unaccompanied minors,\nbeyond PRO.KE.KA Amygdaleza Pre-Removal Centre<\/strong><\/a><strong>**, now also in police stations.
