"From October 2019 until today, the Legal Department of ARSIS - Association for the Social Support of Youth has represented more than 60 children (unaccompanied or in vulnerable families) and young adults (18-21 years old) before the Administrative Courts in International Protection cases.
In all of the above cases, the relevant applications for international protection had been rejected and the applicants had been ordered to return to their country of origin. The legal department of ARSIS filed applications for annulment of the above decisions, as well as applications for temporary judicial protection, in order to reissue the legal documents that had been removed from the applicants and to allow them to stay in Greece until the annulment application is discussed. At the same time, and given the high cost of the relevant procedures, ARSIS lawyers requested that the applicants be exempted from the relevant legal fees and charges, and in many cases requested the appointment of a lawyer for the applicants for free legal aid.
A first insight into the judicial treatment of the above annulment applications was provided by the publication - publication of the "Jurisprudence of Decisions concerning minor asylum seekers 2020-2022" (https://arsis.gr/wp-content/uploads/2022/12/Επιτομή-Νομολογίας-2020-2022-τελικό-WEB-site.pdf).
In view of the publication of the new volume of Case-Law handbook, which will be issued later this year, we present some statistics from the year 2020 until August 2023. We believe that this collection and publication of data makes clear the need to free unaccompanied children, in particular, from the international protection procedure by granting residence permits, at least during the period of minority, as is the case in other EU countries.
